TOWN OF LOXLEY, AL REQUEST FOR QUALIFICATIONS (RFQ)

Proposals will be received by the Town of Loxley of Baldwin County, Alabama, in the Town of Loxley offices, 1089 S. Hickory St. Loxley, Alabama, until 11:00 A.M. Tuesday, November 30, 2021, and then publicly opened thereafter, for furnishing professional services required by the Town of Loxley and described as follows:

Professional Architectural Services for Landscape and Design of a new Loxley Transit Hub FTA/ESMPO 5307 Funded Project

The Town of Loxley is accepting proposals from qualified firms to provide professional landscape architectural services for a Federal Transportation (FTA)/Eastern Shore Metropolitan Planning Organization (ESMPO) 5307 Funded Grant administered through Alabama Department of Transportation (ALDOT). This project will entail the design, letting, project management and construction oversight of a new transit hub. The Town of Loxley will be the project manager.

The company that is awarded the Landscape Architect Contract must have Workman’s Compensation Insurance on all of its employees if work is done on City premises. General Liability Insurance must be maintained to hold the City harmless in the event of an accident. Awarded Landscape Architect must submit to the Town, Proof of Workman’s Compensation Insurance if work is done on Town premises and General Liability Insurance specifying coverage. The Disadvantage Business Enterprise (DBI) Goal is 1.9%. All current or potential government vendors are required to be registered in the System for Award Management (SAM) to be awarded government contracts.

No proposals will be considered unless the Landscape Architect firm, whether resident or non-resident of Alabama, is properly qualified to submit a proposal for this type of work in accordance with all applicable laws of the State of Alabama, including, where applicable, possessing a Certificate of Authorization issued by the State Board of Licensure for the State of Alabama under the CODE OF ALABAMA, Section 34-11, and further, certifies that it has the professional, technical, and administrative personnel with the specific experience and training necessary to provide the services as may be required by the Town. The winning bidder will also need to abide by all State of Alabama Procurement Policies which include Bid Protest Procedures. All FTA clauses and certifications shall be signed and certified. Furthermore, the Engineering firm will meet all current licensing and certifications necessary to perform the scope of work. In addition, the awarded Consultant if non-resident of the State, and if a corporation, shall show evidence of having qualified with the Secretary of State to do business in the State of Alabama, http://sos.alabama.gov/business-entities.

BIDS will be received by Town of Loxley, AL (hereinafter called “Owner”), at the Town of Loxley Public Works Department, 5151 Magnolia Street, Loxley, Alabama 36551 until 10:30 a.m. CST November 4, 2021 and then publicly opened thereafter, for furnishing all labor and materials, and performing all work required by the following project:

Be advised that overnight delivery by express or courier of sealed proposals to the Town of Loxley is not guaranteed.

This project requires a vendor to provide all labor, materials, and equipment to furnish, deliver and erect a 50’x50’ pre-engineered Metal Building, including column reactions and anchor bolts for the foundation to be provided by the Town per specifications provided by the Awarded contractor.

No bids will be considered unless the bidder, whether resident or non-resident of Alabama, is properly qualified to submit a proposal for this construction in accordance with all applicable laws of the State of Alabama. This shall include evidence of holding a current license from the State Licensing Board for General Contractors, Montgomery, Alabama. In addition, non-residents of the State, if a corporation, shall show evidence of having qualified with the Secretary of State to do business in the State of Alabama.

The right is reserved to reject any and/or all bids and to waive informalities and to furnish any item of material or work to change the amount of said Contract.

No bid shall be withdrawn for a period of sixty (30) days subsequent to the opening of bids without the consent of the Owner.

Final Notice – FEMA Public Assistance

FINAL PUBLIC NOTICE

 The Town of Loxley has applied for Federal Emergency Management Agency (FEMA) Public Assistance (PA) Program funding through Alabama Emergency Management (AEM) as a sub-grantee.

Under the National Environmental Policy Act (NEPA), federal actions must be reviewed and evaluated for feasible alternatives and for social, economic, historic, environmental, legal, and safety considerations. Under Executive Order (EO) 11988 and EO 11990, FEMA is required to consider alternatives, and to provide a public notice of any proposed actions in or affecting floodplains or wetlands. EO 12898 also requires FEMA to provide the opportunity for public participation in the planning process and to consider potential impacts to minority and low-income populations. This notice may also fulfill requirements under Section 106 of the National Historic Preservation Act (NHPA).

Funding for the proposed project will be conditional upon compliance with all applicable federal, tribal, state, and local laws, regulations, floodplain standards, permit requirements and conditions.

 Special Flood Hazard Area Zone: This project is for the replacement of damaged WWTP components.  All work is located in an AE zone. Confirmation of location in a Special Flood Hazard Area (SFHA) was determined by the Loxley, Town of Flood Insurance Rate Map, Panel Number: 01003C0657M dated 04/19/2019. The proposed work conforms to all applicable State of Alabama and local floodplain regulations. There is a potential for the facility to be impacted by future flooding events due to its location within the shaded AE zone. The proposed work will not take place in wetlands per the United States Fish and Wildlife Service National Wetlands Inventory and will have no potential to impact or affect wetlands.

Proposed Work and Purpose:

The applicant utilized force account Labor, Equipment, and Materials for Water Leaks for the Town of Loxley. The repairs to the WWTP at 30.61131, -87.76018 were all in-kind repairs totaling $8,441.48. The applicant repaired the effluent pump, oxidation ditch air line, sedimentation influent pit, outfall effluent pit motor, and outfall effluent overload protection.

Project Alternatives:

Alternative #1 (No action): The ‘no action’ alternative would ultimately result in a negative impact on the residence of Baldwin County. If these repairs are not made, then adverse economic and social impacts may occur.

Alternative #2 (Repair with best construction practices) Using adopted best construction practices sub-grantee minimized future effects through applicable codes and standards. All repairs were made after a risk assessment was conducted and various measures implemented to prevent future damages.

Friday, August 6, 2021, and then publicly opened thereafter, for furnishing all labor and materials, and performing all work required by the Town of Loxley and described as follows:

All Bids must be on blank bid forms provided in the Bid documents. Bids shall be accompanied by a BID SECURITY equal to 5% (percent) of the bid price, but in no event more than $10,000.00. BID SECURITY shall be in the form of a Bid Bond signed by a Bonding company authorized to do business in the State of Alabama, or a Cashier’s Check payable to the Town of Loxley. NO BID SECURITY is required on bids less than $10,000.00.

A Performance Bond in the form and terms approved by the Town of Loxley in an amount not less than the sum of the bid will be required at the signing of the CONTRACT, and in addition, a Labor and Materials Bond in the form and terms approved by the Town of Loxley in an amount not less than fifty percent (50%) of the CONTRACT price insuring payment for all labor and materials.

The CONTRACTOR must furnish to the Town of Loxley at the time of the signing of the CONTRACT, a Certificate of Insurance coverage as provided in the contract documents which will include Comprehensive Insurance. The company that is awarded the bid must have Workman’s Compensation Insurance on all its employees if work is to be performed on the Town of Loxley’s premises. General Liability Insurance, specifying coverage, must be maintained to hold the Town of Loxley harmless in the event of an accident. See bid packet for details.
